TSCA NCC - mandated OSHA consultation under amended TSCA

posted 1/31/2018

There are ongoing communications between the U.S. Environmental Protection Agency (EPA) and the Toxic Substances Control Act (TSCA) New Chemicals Coalition (NCC) regarding the mandated EPA consultation process with the U.S. Occupational Safety and Health Administration (OSHA) under TSCA Section 5(f)(5), as amended by the Frank R. Lautenberg Chemical Safety for the 21st Century Act.

Appended for reference is a December 1, 2017, letter from the TSCA NCC to Jeffery Morris, (EPA), regarding the consultation process, as well as an analysis document, TSCA New Chemicals Coalition Position Statement Concerning the Consultation with OSHA Required by New TSCA and EPA Adoption of Restrictions to Address Workplace Exposures, December 2017, which is referenced in the Morris letter.

The TSCA NCC is continuing its dialogue with EPA on this issue, as well as coordinating accordingly with OSHA and other stakeholders.
