Course Description

The Toxic Substances Control Act (TSCA) is the primary regulation governing the import, distribution, and use of industrial chemicals. Many of these chemicals are also used for pesticides, food and food contact, medical, and/or cosmetic and personal care uses, which also subjects them to the Federal Insecticide, Rodenticide, and Fungicide Act (FIFRA) and/or the Federal Food, Drug, and Cosmetic Act (FFDCA). The overlap causes confusion and can lead to significant penalties if not understood and handled properly. This interactive workshop, led by Bergeson & Campbell, P.C., will use a series of case studies, patterned on real-world events, to illustrate how different commercial activities involving chemicals can trigger all three regulations. This includes activities with Safety Data Sheets and labels to address regulatory obligations.

This considered an Intermediate course.

Course Objective

Workshop participants will gain a clearer understanding of TSCA, FIFRA, and FFDCA in action; acquire better awareness of how different activities and product claims shift regulatory jurisdiction; and learn strategies to ensure compliance, and how to respond to regulatory authorities. Participants will also gain a better understanding on the information provided in Safety Data Sheets and labels and how it relates to potential pitfalls in compliance.

Course Director

Karin F. Baron, MSPH
Director of Hazard Communication and International Registration Strategy

Ms. Baron has more than 20 years’ experience developing, implementing, and managing complex chemical regulatory compliance strategies for some of the largest industrial and specialty chemical companies in the world. Her primary areas of practice include navigating the Globally Harmonized System of Classification and Labeling of Chemicals (GHS), including classification, labeling, and authoring of compliant safety data sheets (SDS), hazard and risk assessment, industrial hygiene, and environmental health and safety (EHS) programs. She manages assessments for product manufacturers wishing to comply with the food contact materials and cosmetics regulations under the U.S. Food and Drug Administration (FDA) and consumer products under the U.S. Consumer Product Safety Commission (CPSC) and Canada’s Consumer Chemicals and Containers Regulations (CCCR).

Dr. Richard E. Engler, Ph.D.
Director of Chemistry

Dr. Engler is a 17-year veteran of the U.S. Environmental Protection Agency (EPA) and is one of the most widely recognized experts in the field of green chemistry, having served as senior staff scientist in EPA’s Office of Pollution Prevention and Toxics (OPPT) and leader of EPA’s Green Chemistry Program. He has participated in thousands of Toxic Substances Control Act (TSCA) substance reviews at EPA, as well as pre-notice and post-review meetings with submitters to resolve complex or difficult cases, and he draws upon this invaluable experience to assist B&C clients as they develop and commercialize novel chemistries.
